POLICY, TERMS & CONDITIONS

Warranty and Liability Limitations

Except as may be expressly set forth in the product invoice, Baggster makes no other warranties, express or implied, including any warranties of merchantability, condition of any kind, or fitness for a particular purpose, under the South Dakota Uniform Commercial Code or otherwise.

Motorcycles can be dangerous. Baggster has no control over usage of any part and expects the dealer or customer to exercise good judgment as to the proper selection, application, installation, use and maintenance of any part or kit. Baggster assumes no responsibility for damage or injury of any kind because of the misuse or improper application of any part in any way by any person. Baggster shall not be liable for any indirect or consequential damage whatsoever (including but not limited to loss of use, revenue or profit).

Terms

All new dealers and retail orders are shipped after being secured with a valid credit card such as Visa, Discover, American Express or MasterCard. Terms on open accounts such as distributors are 2% 10 days Net 30 R.O.G. currency US dollars. All sales are final; reimbursement will not be given for cash or credit sales. Return authorization or exchanges may be made at our discretion if product is returned within 30 days of invoice date and determined to be defective by Baggster.

Returns

No returns will be accepted without prior authorization. To obtain authorization numbers please call or email Baggster. Return authorization numbers are valid for 30 days from date of issue.

Warranty

Baggster has a 1 YEAR warranty on all products. Baggster will repair or replace any product that has first been inspected and determined to be defective by Baggster. This warranty is for parts replacement only and does not include any customer added value including paint. Paint and installation is the responsibility of the customer. Baggster handles all returns in house and requires the original receipt (or a copy of the original receipt). Returns must be made using the original box and include the receipt and warranty card. Customer is responsible for return shipping costs; we do not accept COD shipments. If product is determined to be defective and an original, non-altered Baggster product, the return of the product will be sent at no charge.

Claims

The carrier has full responsibility for all merchandise once it leaves our premises. Title to merchandise passes to the customer once carrier receives shipment. All damage claims must be reported to the carrier within 5 days of receipt of shipment.

Shipping

Shipping is the responsibility of the purchasing part and all incurred shipping expenses will be added to the total purchase price at time of shipping unless other arrangements have been made at time of purchase. All dealer and retail orders are shipped UPS ground unless otherwise requested by the customer. Distributor shipments are shipped using the distributor’s UPS account number and billed as receiver. Overseas accounts can be prearranged using an outside carrier. Products will be shipped within time frame requested by customer.

Pricing

All invoices reflect prices in effect at time of purchase. All back orders will be processed according to price in effect at time of purchase order. Price changes (if any) are made annually prior to catalog publishing date.

Wholesalers/Distributors

The state of South Dakota requires a Certificate of Exemption on file for each company claiming tax exempt status
